Terms of Service

These Terms of Service ("Terms") govern your use of the Dejavu mobile application ("Dejavu", "the app", or "the Service"), operated by Bulat Khairullin, an individual entrepreneur registered in Georgia ("we", "us", or "our"). By downloading, accessing, or using Dejavu, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Dejavu is a flashcards app that lets you create, import, organize, and study two-sided flashcards. It includes features that use artificial intelligence to generate or help generate flashcards and answers, and features that sync your content across your devices.
2. Eligibility
You must be at least 13 years old to use Dejavu. If you are under 18 (or the age of majority where you live), you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms. By using the Service, you represent that you meet these requirements.
3. Your Account
You can use Dejavu without an account, in which case your data is stored on your device. You may also sign in using Sign in with Apple to sync your content across devices. You are responsible for activity that occurs through your account and for keeping access to your device and account secure. Please notify us promptly of any unauthorized use.
4. License to Use the App
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Dejavu on devices you own or control, for your personal, non-commercial use. You may not copy, modify, distribute, sell, or lease any part of the Service, reverse engineer or attempt to extract the source code of the app (except to the extent this restriction is prohibited by law), or use the Service in any way not permitted by these Terms.
5. Your Content
"Your Content" means the flashcards, folders, text, notes, and materials (such as documents, photos, and images) you create, upload, or import into Dejavu.
- You own Your Content. We do not claim ownership of it.
- You grant us a license to operate the Service. You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, display, and process Your Content, and to provide it to our service providers (including the AI provider described in Section 6), solely to operate, provide, secure, and improve the Service for you (for example, to sync your cards across your devices and to generate the AI output you request).
- You are responsible for Your Content. You represent and warrant that you own or have the necessary rights to Your Content, that it does not infringe or violate the rights of others or any law, and that uploading and processing it as described does not violate any agreement or right.
6. AI Features
Dejavu uses third-party AI technology, including Google's AI services (Google Cloud Vertex AI / Gemini), to generate flashcards, answers, and related content. By using AI features, you acknowledge and agree that:
- the content you submit (prompts, attached materials, and relevant card text) is sent to and processed by the AI provider;
- you must comply with the AI provider's applicable policies, including the Google Generative AI Prohibited Use Policy;
- AI-generated content is produced automatically, may be inaccurate, incomplete, outdated, offensive, or otherwise unexpected, and is not professional advice of any kind;
- you are responsible for reviewing AI output before relying on it or sharing it;
- we may change, limit, suspend, or discontinue AI features, or change AI providers, at any time;
- AI features depend on third-party services whose availability we do not control.
7. Acceptable Use
You agree not to use the Service to create, upload, generate, store, or share content, or to engage in conduct, that:
- is unlawful or facilitates illegal activity;
- relates to the sexual abuse or exploitation of children, or otherwise endangers children;
- is non-consensual intimate imagery, or sexually explicit content created for pornographic purposes;
- promotes, incites, or facilitates violence, terrorism, self-harm, harassment, bullying, or hatred against individuals or groups;
- infringes intellectual property rights or misappropriates trade secrets;
- violates the privacy or other rights of others, or uses other people's personal data without authorization;
- is deceptive or fraudulent, or is intended for scams, phishing, or impersonation;
- contains or distributes malware, or attempts to disrupt, overload, or gain unauthorized access to the Service or related systems;
- attempts to circumvent the Service's safety filters, usage limits, or other technical or security measures;
- uses automated means to access the Service except as we expressly permit;
- uses AI output to develop or train a competing model or service, or otherwise resells or commercially exploits the Service or its output without our permission.
We may review, filter, refuse, remove, or restrict content, and may suspend or terminate access for users who violate this section or the AI provider's policies.
8. Subscriptions, Usage Limits, and Fair Use
Dejavu is free to download and use, and it offers an optional auto-renewable subscription ("Dejavu Pro") that unlocks expanded AI generation and other premium features. The following applies to subscriptions purchased through the Apple App Store:
- Billing. Payment is charged to your Apple Account when you confirm the purchase. The price and billing period (for example, monthly or annual) are shown in the app before you confirm.
- Auto-renewal. Your subscription renews automatically for the same period at the then-current price unless you turn off auto-renewal at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within the 24 hours before the period ends.
- Free trial. If a free trial is offered (for example, on the annual plan), the subscription begins and your Apple Account is charged when the trial ends unless you cancel at least 24 hours beforehand. Any unused portion of a free trial is forfeited when you purchase that subscription.
- Managing and canceling. You can manage your subscription, change your plan, or turn off auto-renewal at any time in your Apple Account settings. Deleting the app does not cancel your subscription.
- Refunds. Purchases are processed by Apple and are subject to Apple's policies; refund requests are handled by Apple, not by us, except where required by law.
- Changes. We may change the features, limits, or price of a subscription for future billing periods; any price change applies only after you are notified in accordance with Apple's rules.
AI generation and certain other features are subject to usage limits (for example, daily, weekly, and overall quotas) and to fair-use policies designed to keep the Service available and reliable for everyone. We may apply, change, or remove these limits, and may throttle, restrict, or review accounts with excessive or abusive usage.
9. Intellectual Property
The Service, including the app, its software, design, text, graphics, logos, and the "Dejavu" name, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited license in Section 4, these Terms do not grant you any rights in the Service. If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or any obligation to you.
10. Third-Party Services
The Service relies on third-party platforms and services, including the Apple App Store, Google Play, cloud hosting and database providers, the sign-in provider, and the AI provider described above. Your use of those services may be subject to their own terms and policies. We are not responsible for third-party services, and their availability or changes may affect the Service.
11. Termination
You may stop using the Service at any time and may delete your account from within the app. We may suspend or terminate your access to the Service, in whole or in part, at any time if you violate these Terms or the AI provider's policies, if required by law, or to protect the Service or its users. Provisions that by their nature should survive termination, including Sections 5, 9, 12, 13, 14, and 16, will survive.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PURPOSE. YOU USE THE SERVICE AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $50. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT FULLY APPLY TO YOU.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold us harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms or the rights of others.
15. Changes to the Service and These Terms
We may modify or discontinue the Service or any part of it at any time. We may also update these Terms from time to time; when we do, we will revise the "Last updated" date and, where appropriate, provide additional notice in the app. Changes take effect when posted. Your continued use of the Service after changes take effect means you accept the updated Terms.
16. Governing Law
These Terms are governed by the laws of Georgia (the country), without regard to its conflict-of-laws rules. Subject to applicable law, the courts located in Tbilisi, Georgia will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, and you consent to their jurisdiction. Nothing in these Terms limits any mandatory consumer-protection rights you have under the laws of your country of residence.
17. Apple App Store - Additional Terms
If you obtained Dejavu from the Apple App Store, the following also applies:
- These Terms are between you and us only, not with Apple, and Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claims by you or a third party relating to the app, including product-liability, legal or regulatory, or intellectual-property claims.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
18. Google Play - Additional Terms
If you obtained Dejavu from Google Play, your use is also subject to the Google Play Terms of Service. To the extent of any conflict between these Terms and the Google Play Terms of Service regarding your acquisition or use of the app through Google Play, the Google Play Terms of Service control with respect to that subject matter.
